In July 2026, Spain took a significant step forward in tobacco control by approving a draft law to extend smoking bans and tighten regulations on tobacco-related products. This reform, set to update legislation from 2005, aims to address new consumption habits and the rise of products like e-cigarettes, nicotine pouches, and shisha pipes.

Expanded Smoke-Free Areas

One of the most notable changes is the prohibition of smoking and vaping on terraces of bars, restaurants, and hospitality venues, as well as on sea and river beaches, public swimming pools, sports facilities, national parks, and work vehicles (except personal use). The law also introduces 15-metre "protection zones" around entrances to public buildings, hospitals, schools, universities, libraries, museums, cultural centres, and children’s playgrounds.

Youth Protection and Product Regulation

For the first time, the draft explicitly bans tobacco consumption by under-18s, not just the sale and supply. Despite a decline in daily smokers among youth aged 14 to 18, recent data shows 15.5% have used tobacco in the past month, highlighting the need for stronger measures.

The reform equates e-cigarettes and similar devices with conventional cigarettes regarding where they can be used, covering products with or without nicotine and herbal smoking devices. It also restricts sales to specialist outlets that must comply with forthcoming Ministry of Health regulations, including bans on visible advertising.

Advertising and Penalties

The law tightens advertising restrictions across all media, including online platforms and vending machines, banning direct and indirect promotion. In audiovisual content, tobacco use or display by presenters and guests will be prohibited, along with brand visibility.

Penalties for violations will range from fines of €200 to €600,000, depending on severity. Minors caught consuming tobacco may face fines starting at €200 or community service alternatives.

Following final parliamentary approval and publication, the law will come into effect 20 days later, with a two-month period for establishments to update signage accordingly.
